CUSTOMER SERVICE
GENERAL PROVISIONS
This Agreement is published by LLC Elusso (hereinafter referred to as the “Company”) and sets out the essential terms and conditions for using the Company’s payment service when purchasing its products online.
The offer to adhere to the terms of this Agreement is addressed to individuals who wish to pay for the Company’s products via the payment service available on the Company’s website at https://lapeal-store.com (hereinafter referred to as the “Website”), using bank cards of various payment systems, including but not limited to Visa and MasterCard, in accordance with the rules of the acquiring bank.
By accepting the terms of this Agreement, you express your full and unconditional consent to all provisions set forth herein and confirm to the Company that you possess the necessary legal capacity and authority to enter into and perform this Agreement in accordance with its terms.
TERM OF VALIDITY
From the moment you accept this Agreement, all its provisions and requirements become binding upon you.
 Acceptance of this Agreement is carried out through specific actions or a series of actions aimed at completing payment for the Company’s products via the Company’s payment service.
The current version of this Agreement is published on the Company’s Website at https://lapeal-store.com. The Company ensures that you have access to this Agreement at any time, including immediately prior to making payment, by providing a reference link to its terms on the Company’s Payment Page.
The Company reserves the right to amend the text of this Agreement at its sole discretion. All amendments take effect immediately upon publication of the updated version and apply to all subsequent payment transactions for the Company’s products.
We recommend that you review the text of this Agreement carefully each time before making a payment. If you do not agree with any of its provisions, you are advised to refrain from purchasing the Company’s products via the payment service.
THIRD PARTIES AND PARTNERS
The Company may, at its discretion, engage third-party service providers to perform obligations under this Agreement, with the right to appoint subcontractors.
 The Company guarantees that all third-party service providers involved in the operation of the Payment Page comply with the security standards of international payment systems.
TERMINOLOGY
Unless the context requires otherwise, the following terms used in this Agreement shall have the meanings set forth below:
Company — the settlement participant that administers and manages the Payment Service, providing you and other partners with information and technological support in connection with payments for the Company’s products made via bank cards or through the Fast Payment System (FPS).
SETTLEMENT BANK
A Settlement Bank refers to a financial institution authorised to process the transfer of funds, including electronic funds, acting as the Company’s financial partner (acquiring bank). It is responsible for executing transactions performed with payment cards, for the purpose of paying for the Company’s products.
ISSUING BANK (THE ISSUER)
The Issuing Bank (Issuer) means the financial institution with which you hold an agreement for the issuance and maintenance of your payment card used to pay for the Company’s products.
 For the purposes of this Agreement, the Issuing Bank shall also include the financial institution where your account is held, if such account is used to make payments for the Company’s products.
BANK CARD
A Bank Card refers to a payment card issued by the Issuing Bank in accordance with the rules of the applicable payment system.
BANK ACCOUNT
A Bank Account refers to the account opened in your name by the Issuing Bank and used to make payments for the Company’s products.
PAYMENT PAGE
The Payment Page refers to the Settlement Bank’s online resource, implemented as a suite of software hosted on the Internet under a unique web address generated for each payment transaction.
 The page provides an interface allowing you, by means of your Bank Card, to create and transmit to the Issuing Bank, via the Settlement Bank, an Order for payment of the Company’s products, or to issue a Confirmation for transfer in order to complete payment.
PAYMENT SERVICE
The Payment Service (the “Service”) means the combination of hardware, communication channels, and other technological infrastructure enabling information and technical interaction between the participants in settlements when making payments for the Company’s products, as described in this Agreement.
CONFIRMATION
A Confirmation refers to an electronic document created and transmitted by you to the Issuing Bank during the authorisation process, either via QR code or hyperlink. It contains all requisite details necessary to execute payment in accordance with applicable international and local laws and relevant banking regulations. This document serves as the legal basis for executing the transfer of funds to pay for the Company’s products.
ORDER
An Order refers to an electronic document serving as the basis for executing a transfer. It is created and transmitted by you to the Issuing Bank via the Settlement Bank, or generated by the Issuing Bank and transmitted to the Settlement Bank upon your Confirmation following successful Authorisation.
PAYMENT FOR THE COMPANY’S PRODUCTS (TRANSFER)
Payment for the Company’s Products (Transfer) refers to the actions performed by the Settlement Bank in accordance with applicable forms of cashless settlement using your card or account, subject to successful authorisation, to transfer funds to the Company’s bank account in settlement of the purchase.
AUTHORISATION
Authorisation refers to the verification by the Issuing Bank, using your authentication data, of your right to access and use the card or account through the Payment Service in order to create and send to the Settlement Bank the relevant Order or Confirmation for transfer.
AUTHENTICATION DATA
Authentication Data refers to information provided by you to the Issuing Bank enabling successful Authorisation.
 Such data identifies the person who created the Order or Confirmation using the card or account.
 PLEASE NOTE: To complete transfers, the financial institution may require you to provide personal details such as your full name, date of birth, ID document details, phone number, e-mail address, or taxpayer identification number.
PARTICIPANTS IN SETTLEMENTS
Participants in Settlements refers collectively to all parties involved in the payment process, including but not limited to: you, the Company, the Settlement Bank, the Issuing Bank, and their partners and representatives.
PURPOSE AND SUBJECT OF THE AGREEMENT
This Agreement is deemed fully and unconditionally accepted by you at the moment of its acceptance.
 Its purpose is to ensure informational and technological interaction among the Participants in connection with the provision of the Payment Service by the Company via the Payment Page, enabling you to create, confirm, and transmit Orders or Confirmations for transfer through the Settlement Bank.
PROVISION OF THE PAYMENT SERVICE
Access to the Payment Service, including the ability to enter the required Authentication Data to create an Order or Confirmation for transfer, is granted to you by the Company only after acceptance of this Agreement — namely, upon clicking the “Pay” button on the Company’s Website when purchasing the Company’s products.
After acceptance, you will be redirected to the Settlement Bank’s Payment Page to create the corresponding Order or Confirmation.
 Information regarding the terms of the Settlement Bank and the Issuing Bank will be available on the Payment Page for your review and acceptance prior to making any payment.
The basis for executing payment for the Company’s products under this Agreement shall be a successful Authorisation, carried out based on your Order submitted through the Payment Service.
To complete payment, please follow the sequential steps displayed on the Payment Page:
  • Select the preferred payment method: Bank Card;
  • Enter your Authentication Data and other required payment details (or use the data previously provided during Website registration);
  • Click the virtual “Pay” button (or a similar button) on the Payment Page. This action will initiate the electronic transmission of your Order or Confirmation to the Issuing Bank via the Settlement Bank;
  • During Authorisation, confirm the data entered and, where applicable, consent to the deduction of any commissions charged by the Settlement Bank or Issuing Bank (if applicable and communicated to you in advance), as well as consent to the processing of your personal data.
Upon successful Authorisation, the Company will immediately notify you in real time of the payment status.
 For the purpose of executing your Order, the Company ensures data exchange among all Participants in settlements.
The transfer of monetary or electronic funds is executed by the Settlement Bank.
FEES AND CHARGES
For executing payment transfers, the Settlement Bank or the Issuing Bank may charge you a commission in accordance with their current tariffs.
 The Settlement Bank and/or Issuing Bank reserve the right to unilaterally amend their tariffs, in whole or in part, for the provision of settlement services.
 Such amendments shall take effect from the date of publication of the updated tariffs on the relevant financial institution’s website.
The Company does not impose or collect any fees, commissions, or other payments for granting access to the functionality of the Payment Service.
MISCELLANEOUS PROVISIONS
Access to the Issuing Bank’s resources is provided only if the Issuing Bank uses 3-D Secure technology.
 The Company shall not be liable for any refusal to process a transaction if the Issuing Bank does not employ 3-D Secure technology.
The Company shall not be held responsible for any failure or improper performance of its obligations under this Agreement if such failure results from:
  • decisions of governmental or regulatory authorities that make it impossible for the Company to fulfil its obligations hereunder;
  • causes beyond the Company’s reasonable control (including the actions or omissions of third parties, such as Participants in settlements);
  • the occurrence of force majeure circumstances.
The Company shall not be responsible for any errors made by you in entering or confirming payment details on the Payment Page.
By accepting this Agreement, you:
  • confirm that you have read and agree to its terms;
  • confirm that you meet all the requirements specified herein;
  • consent to the processing of the data you provide when forming the payment order, in accordance with the Company’s Privacy Policy.
  •  You further consent to the transfer of your personal data to third parties for the purposes described in this Agreement, provided that such third parties have entered into duly executed agreements ensuring compliance with data protection laws.
If you refuse to provide consent for the processing of personal data by the Company and/or authorised third parties, payment transactions cannot be executed under this Agreement.
You represent and warrant that the information you provide is accurate and complete. The Company shall not be liable for any inaccuracy, falsification, or lack of authorisation to use the information you submit.
You bear sole responsibility for any breach of law or third-party rights arising from your actions.
 You assume all risks associated with any material change of circumstances from those existing at the time of acceptance of this Agreement, and such changes shall not constitute grounds for non-performance of your obligations.
CLAIMS AND DISPUTES
Any claims concerning the operation of the Payment Service may be submitted via the feedback form available on the Website.
 All received communications will be reviewed within thirty (30) calendar days from the date of receipt.
When resolving disputes arising from this public offer or from the Payment Page interface, the following documents shall serve as evidence of the facts claimed by either party:
  • the electronic receipt generated on the Payment Page;
  • the electronic journal/register of transactions performed with bank cards or accounts, containing information about the relevant transaction.
In the event of any inconsistency between these documents, the electronic journal/register of transactions, as maintained by the Settlement Bank, shall be deemed conclusive proof of your acceptance of this Agreement and the validity of the transaction performed.
All matters related to the use of the Company’s Payment Service (including pre-contractual disputes and claims) shall be governed by applicable international and local laws.
All legal proceedings arising in connection with the use of the Payment Service or related partner services shall be subject to the jurisdiction of the courts of the Company’s registered location.
 However, the Company reserves the right to initiate proceedings in the jurisdiction of your primary residence in cases of breach of this Agreement. You hereby waive any objections to the exercise of such jurisdiction.
